Do I Need My Own Lawyer in a Real Estate Transaction in Florida?
Do buyers and sellers in Florida really need to hire their own attorney during a real estate transaction?
In many Florida real estate transactions, buyers and sellers complete the process without hiring a personal attorney because title companies and REALTORS® handle much of the transaction process. However, there are situations where having your own attorney can provide extra protection, advice, and peace of mind depending on the complexity of the deal.
Florida Real Estate Closings Work Differently Than Some States
One thing many people moving to Florida do not realize is that Florida is not considered a strict “attorney closing” state like some others. In many states, attorneys handle nearly every part of the transaction from contract preparation to closing.
Here in Florida, title companies often handle the closing process along with the real estate agents involved in the transaction.
As an agent with CrossView Realty, I explain to buyers and sellers all the time that the title company’s role is to make sure:
The title is clear
Liens are handled properly
Funds are distributed correctly
Closing documents are prepared
Ownership transfers correctly
For many standard residential transactions in Jacksonville, St. Johns, Fleming Island, or St. Augustine, this process works very smoothly without either party hiring a personal attorney.
When You May Want Your Own Attorney
Even though many transactions close without attorneys directly representing the buyer or seller, there are definitely situations where hiring your own lawyer can be a smart move.
Some examples include:
Estate or probate sales
Divorce situations
Commercial property purchases
Boundary disputes
Title issues
Tenant-occupied properties
Seller financing agreements
Complicated contract negotiations
Foreclosure or short sale transactions
If something feels unusually complicated or legally sensitive, having your own attorney may provide an extra layer of protection and explanation.
Understanding the Difference Between a REALTOR®, Title Company, and Attorney
This is something that can confuse buyers and sellers.
As a REALTOR®, my job is to help guide the transaction, negotiate terms, market the property, coordinate the process, and help protect my customer’s interests throughout the deal.
The title company focuses on the legal transfer of ownership and handling the closing process.
An attorney, however, represents one party directly and can provide legal advice specific to your situation.
That is a very important distinction.
A title company is generally considered a neutral third party in the transaction, while a personal attorney works specifically for you.
Some Buyers and Sellers Simply Want Peace of Mind
Sometimes there is no major legal issue at all. Some people simply feel more comfortable having an attorney review documents before signing.
I completely understand that.
Buying or selling a home is one of the biggest financial decisions most people will ever make. If hiring an attorney gives you confidence and peace of mind, it may absolutely be worth it.
My Advice to Buyers and Sellers in Northeast Florida
I always tell my customers not to be afraid to ask questions during a transaction. If something does not make sense, slow down and ask for clarification.
Most standard residential real estate transactions in Northeast Florida move along very well with the help of experienced agents and reputable title companies. But every transaction is different.
If there are legal concerns, unusual family situations, inheritance issues, or complicated financial matters, bringing in a qualified Florida real estate attorney can be a very smart decision.
Final Thoughts
You may not always need your own attorney in a Florida real estate transaction, but there are certainly situations where having one can provide valuable protection and peace of mind.
The most important thing is understanding your transaction, asking questions, and surrounding yourself with professionals who will guide you honestly through the process.
If you are thinking about buying or selling a home in Jacksonville, Mandarin, Ponte Vedra Beach, Nocatee, or anywhere in Northeast Florida, I would be happy to help point you in the right direction and connect you with trusted professionals when needed.
